PUBLIC HEARING (BUDGET/LOCAL LAW 2 – 2026/LOCAL LAW 3 -2026)
MAYOR CERIELLO: So we're going to move on to item number three which is the public hearing, the final budget. We have before us the budget that was posted as the draft budget for fiscal year '26/'27. So it starts on June 1st of '26 and it rolls over to May 31st, '27. From the public, any comments on the budget, questions? No. All right. I'll make a motion to move to approve and adopt the final budget for '26/'27 as described.
TRUSTEE MILLER: I second.

Thank you. It's a great budget, by the way. So this is with regard to Local law 2 concerning swimming pools. We've been studying this matter since it came to our attention that we have a need for more specific reference to hot tub spas and therapeutic spas, whether permanent or moveable. So the change to our law concerning swimming pools is rather modest, but it does lump in with swimming pools which are regulated and have to meet certain building code requirements, hot tub spas and therapeutic spas, which were not so regulated. Do I need to read the local law?
VILLAGE ATTORNEY MORICI: This has also been presented previously and discussed at a prior meeting. It's been published, so you don't necessarily need to as long as the trustees are all on the same page.
MAYOR CERIELLO: As discussed in the prior meeting, because we've been looking at this, the change to the law really is just as I
said to include hot tub spas and therapeutic spas in the definition of swimming pools. And we did one thing here which is a little odd. We decided that a swimming pool was something that has water over 24 inches deep. I didn't think that it was right to include puddles or something small, if they have a kids blow-up pool as a swimming pool that would be subject to regulation. So that's there just for clarification purposes. Does the Board have any questions or comments on the proposed legislation?

MAYOR CERIELLO: I'm going to move that we adopt Local Law 2 of 2026 entitled the local law amending Article 7, "General and Supplemental Regulations," Section 200-35 of the Village Code entitled Swimming Pools. Do I have a second?

MAYOR CERIELLO: Okay, great. Thank you. That's that.
We have proposed a local law, Local Law 3 of 2026 entitled EV Charging Stations. It was published, according to the law by the Board of Trustees, it's been posted on our website. But a little bit of background on 4 this. We do allow residents to have EV charging stations at their home, so this would not regulate any charging station in a residential structure, but just the commercial district. And the genesis of this is what is happening right now behind the Apple store where the owner of that property installed, I think, 12 charging stations and they butt right up to the residential district without any separation or setback. And I understand it's a complicated process and situation there, but I don't want a similar situation to arise in our Village where we have a commercial district with charging stations backing up to the homes and then having people charge their cars late at night.
DEPUTY MAYOR MILLER: Right.
TRUSTEE IM: Yes.
MAYOR CERIELLO: So I will read the local law, it's entitled Local Law 3 of the year 2026, a local law to establish a temporary filing -- yes, I'm sorry saying this as if it's the law, it's a moratorium to study it further.
DEPUTY MAYOR MILLER: Right, understood.
MAYOR CERIELLO: My apologies for that. A temporary moratorium and filing of the application, acceptance, approval and issuance of permits by the Incorporated Village of Munsey Park for any electric vehicle, EV charging stations not fully contained in a residential structure and battery energy storage systems within the Village. The local law will be known as the Village of Munsey Park Temporary Moratorium Law. It's being adopted pursuant to Municipal Home Rule Law Number 10. Its purpose is to address Village concerns regarding the potential impact of installation of electric vehicle EV charging stations and battery energy storage systems within the Village, including placement of such chargers or systems, the fire risk related to battery technology and the lack of formal zoning regulations for such infrastructure. The Village Board believes a temporary moratorium on EV charging stations and the battery energy storage systems will allow the Village time to consider zoning laws, address placement issues, and evaluate fire safety as well as create guidelines for commercial installations and battery storage. As a moratorium, this local law is a Type II action under the State Environmental Quality Review Act regulations and it's not subject to further environmental law review. This moratorium will be imposed for a period commencing on the effective date of this 13 local law and continuing until June 10th, 2026 and may be extended by the Village Board by resolution for two additional three-month time periods or for such additional periods that are reasonable in scope or duration. And the balance of the local law is just the severability and the effective date. The effective date is immediately upon filing with the Secretary of State. ANNUAL MEETING AND APPOINTMENTS
On a motion by Mayor Ceriello and seconded by Deputy Mayor Miller, the Board of Trustees unanimously approved the following appointments for one-year terms expiring the first Monday of April 2027, pursuant to §4-400 of the Village Law of the State of New York.

BE IT FURTHER RESOLVED, that the Investment Policy is updated to reflect that Connect One be the Village’s Official Bank;
BE IT FURTHER RESOLVED, that Connect One is hereby designated as the OFFICIAL DEPOSITORY for the current official year and that the Clerk/Treasurer be authorized to deposit funds as outlined in the Investment Policy adopted by the Board of Trustees on January 14, 1987 and amended June 12, 1996; and
BE IT FURTHER RESOLVED, that the Accounting Policy that all bills are reviewed by Trustee REGINA IM and all accounting entries are reviewed by Cullen & Danowski, LLP., Certified Public Accountants, for any adjustments and reconciliation;
BE IT FURTHER RESOLVED, that all meetings of the Village Board of Trustees shall begin at 7:30p.m.; and
BE IT FURTHER RESOLVED, that the Meeting dates for the forthcoming Official Year are as follows:

BE IT FURTHER RESOLVED, that the Board of Zoning & Appeals (BZA) meetings shall be held as needed on the Third Monday of the month and begin at 7:00p.m.;
BE IT FURTHER RESOLVED, that the Board of Trustees has determined that attendance by certain municipal officers and employees at one or more meetings during the coming official year will benefit the municipality and the Clerk/Treasurer or Deputy Clerk/Court Clerk be, and hereby is authorized to attend the regular meetings of their respective State, county and local associations; and
BE IT FURTHER RESOLVED, that the member of the Zoning Board of Appeals, the Mayor and the Board of Trustees are authorized to attend any training schools as required or deemed appropriate;
BE IT FURTHER RESOLVED, that the Village Justice and Acting Village Justice are authorized to attend State or County continuing Judicial Education Programs; and
BE IT FURTHER RESOLVED, that the CODE ENFORCEMENT OFFICER is authorized to attend the annual State Building Officials Conference; and
BE IT FURTHER RESOLVED, that the Board of Trustees shall approve reimbursement to such officers or employees for actual expenses and/or for mileage at the rate per mile set by the Internal Revenue Service for travel in their personal automobiles to these meetings, schools and conferences.
MINUTES
A motion to approve the minutes for March 11, 2026, Board of Trustees meeting was made by Deputy Mayor Miller, seconded by Trustee Im, and approved by all.
NEW BUSINESS
98 TRUMBULL - STEWART
Representing 98 Trumbull Road (Stewart Residence), Scott Tyrone submitted a regrading application. Upon a motion by Mayor Ceriello and a second from Trustee Im, the application was approved by all.
FUN RUN
Mayor Ceriello made a motion to approve the MPWC 16th Annual Fun Run on Saturday, June 6th, seconded by Deputy Mayor Miller and approved by all. The event will take place between 9:00AM-10:30AM (with road closures starting at 8:30AM and ending at around 10 am). The race will begin and end at Polliwog Pond. The Fair following the race will also take place at Polliwog Pond.
The roads that will be affected by closures are:
· Kensett (at Trumbull to Blackburn)
· Trumbull (dead-end to Waldo)
· Abbey (between Trumbull & Kensett)
· Barnard (entire street)
· Waldo (entire street)
· Bingham (entire street)
· Blackburn (Kensett to Waldo)
The event course will remain the same as in previous years.
VILLAGE REPORTS
JUSTICE REPORT: The Monthly Justice Report for March 2026 notes total fines assessed in the amount of $653.00.
BUILDING REPORT: The Building Report notes that between June 1, 2025, to April 7, 2026, a total of 94 permits has been issued totaling $141,948 in Building Permit Fees.
POLICE REPORT: The Police Report incident February 2026 notes no Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, no Larceny (other than auto), no Criminal Mischief incidents and a total of 24 summonses (19 Movers and 5 Parkers).
