 MAYOR’S REPORT

NASSAU COUNTY HAZARD MITIGATION PLAN

The Mayor read the following resolution Authorizing the adoption of the Nassau County Hazard Mitigation Plan:

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE INCORPORATED VILLAGE OF MUNSEY PARK AUTHORIZING THE ADOPTION OF THE NASSAU COUNTY HAZAED MITIGATION PLAN.

 WHEREAS, all of Nassau County has exposure to natural hazards that increase the risk to life, property, environment and the County’s economy; and

 WHEREAS, pro-active mitigation of known hazards before a disaster event can reduce or eliminate long-term risk to life and property; and

 WHEREAS, The Disaster Mitigation Act of 2000 (Public Law 106-390) established new requirements for pre and post disaster hazard mitigation programs; and

 WHEREAS, a coalition of Nassau County municipalities with like planning objectives has been formed to pool resources and create consistent mitigation strategies within Nassau County; and

 WHEREAS, the coalition has completed a planning process that engages the public, assesses the risk and vulnerability to the impacts of natural hazards, develops a mitigation strategy consistent with a set of uniform goals and objectives, and creates a plan for implementing, evaluating and revising this strategy;

NOW, THEREFORE, BE IT RESOLVED that the INCORPORATED VILLAGE OF MUNSEY PARK:

 (1)               Adopts in its entirety, the Nassau County Hazard Mitigation Plan (the “Plan”) as the jurisdiction’s Natural Hazard Mitigation Plan and resolves to execute the actions identified in the Plan that pertain to this jurisdiction.

(2)               Will use the adopted and approved portions of the Plan to guide pre- and post-disaster mitigation of the hazards identified.

 (3)               Will coordinate the strategies identified in the Plan with other planning programs and mechanisms under its jurisdictional authority.

 (4)               Will continue its support of the Mitigation Planning Committee as described within the Plan.

 (5)               Will help to promote and support the mitigation successes of all participants in this Plan.

 (6)               Will incorporate mitigation planning as an integral component of government and partner operations.

 (7)               Will provide an update of the Plan in conjunction with the County no less than every five years.

 VILLAGE PROSECUTOR

Mayor Ceriello made a resolution to approve Mamie Fulgieri as the new Village Prosecutor.  She will begin her duties on the first Monday of February 2021.   The forgoing resolution was moved by Trustee Williams and seconded by Trustee LiCalzi, and adopted as follows:

 PUBLIC SAFETY REPORT

POLICE REPORT: The Police Report for December 2020.was presented by Trustee Williams, stating 1 Auto Accidents, no Burglary-Residence, no Burglary-Business, no Robberies, one Larceny-Auto incident, two Larceny (other than auto), one Criminal Mischief incidents and a total of 11 summonses (11 Movers and 0 Parkers). 

JUSTICE REPORT: The Monthly Justice Report for January 2021 was presented by Trustee Williams with total fines assessed in the amount of $1,118.

BUILDING REPORT: The Building Report was presented by Trustee Williams, stating that between June 1, 2020 and February 7, 2021, a total of 167 permits have been issued totaling $154,974.50 in Building Permit Fees.

 Motion to close the Board of Trustees meeting was made by Deputy Mayor D’Angelo, seconded by Trustee Williams and approved by all at 8:09 PM.

MAYOR’S REPORT
AWARD THE BID AMOUNT FOR THE ROAD REPAVING PROJECT OF 2021

The Mayor stated that the Village solicited bids from contractors for the phases of re-pavement of Park Avenue. Phase one - National Grid will be installing new gas mains on Park Avenue, from Morse Lane to the end of Park Avenue/Port Blvd., including a small section of Trumbull Road and Bartlett Drive.  Installing the gas main will require the road to be cut out closest to the curb and then restored with a temporary patch. The Village will repave this section of the road, curb to curb, with National Grid incurring half of the costs.  This phase will also include the re-pavement of Park Ave. from Morse Lane to the traffic light at Abbey Road.  Phase 2 – The Village will partner with Manhasset Lakeville Water District when they install a new water main on Park Avenue, from Manhasset Woods Road to Ridge Crescent.  A total of twelve bid books were distributed to interested contractors and ten bids were received.  The lowest bidder on the combined job was United Paving Inc. who has worked closely with the Village before on the Stuart/Eakins/Bellows pavement project last year. 

A motion to accept the bid amount of $390,497 submitted by United Paving for the work described in the bid package and authorization to move forward with the contract was made by Deputy Mayor D’Angelo, seconded by Trustee Williams, and approved by all.

RESOLUTION AUTHORIZING THE IMPLEMETATION AND FUNDING FROM THE MMF STATE-AID PROGRAM

Mayor Ceriello read the following resolution:

AT A REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE

INCORPORATED VILLAGE OF MUNSEY PARK HELD ON January 13, 2021:

A resolution Authorizing the implementation, and funding in the first instance of the State-aid Program eligible costs, of a capital project, and appropriating funds therefore, was proposed:

WHEREAS, a Project for road repair within the Incorporated Village of Munsey Park P.I.N. 0761.89.301 (the “PROJECT") is eligible for funding under a New York State Program administered by the New York State Department of Transportation (NYSDOT); and

WHEREAS, a sum not to exceed one hundred fifty thousand dollars ($150,000.00) in Program Funding is available to progress the project.

WHEREAS, the Incorporated Village of Munsey Park desires to advance the Project by making a commitment of 100% of the State share of the costs of the PROJECT.

NOW, THEREFORE, the Board of Trustees of the Incorporated Village of Munsey Park (hereinafter “the Board”), duly convened does hereby RESOLVE, that the above-subject project is hereby approved; and it is hereby further

RESOLVED, that the Board hereby authorizes the Clerk-Treasurer of the Incorporated Village of Munsey Park (hereinafter the “Village”) to pay in the first instance 100% of the cost of the PROJECT for the PROJECT or portions thereof; and it is further

RESOLVED, that the sum of $390,497.00 is hereby appropriated from the 2020-2021 Annual Budget of the Village and made available to cover the cost of participation in the above phase of the Project; and it is further

RESOLVED, that in the event the full state share costs of the project exceeds the amount appropriated above, the Board shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the Clerk of the Village thereof, and it is further

RESOLVED, that the Mayor of the Village be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for State Aid on behalf of the Village with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the Village’s first instance funding of project costs and permanent funding of the local share of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible, and it is further

RESOLVED, that a Certified Copy of this resolution be filed with the New York State Commissioner of Transportation of the State of New York by attaching it to any necessary Agreement in connection with the Project between the Village and the State of New York; and it is further

RESOLVED, this Resolution shall take effect immediately.

 NATIONAL GRID

The Mayor reported that National Grid is moving along with replacing gas mains on several side streets in Munsey Park which include Remington, Abbey, Hunt, Whistler, Homer, Durand, Alston, Sargent and Revere.  National Grid has agreed to open the concrete panel where the road is deteriorating and replace the road at no cost to the Village. 

RESOLUTION TO APPROVE ELECTION INSPECTORS FOR THE MARCH 16, 2021 ELECTION

Mayor Ceriello read the following resolution:

RESOLVED, that pursuant to section 15-116 of the NYS Election Law, this Board does hereby appoint the following persons to serve as Inspectors of Election on Election Day, March 16, 2021 from 12 pm to 9 pm:  Christina and Kevin O’Toole of 289 Crabapple Road and it was further RESOLVED, that compensation shall be at the rate of $200 per day.

FINANCIAL REPORT

Deputy Mayor D’Angelo presented the Fiscal Year May 31, 2020 Budget Transfers to close out the year.   These are unanticipated expenditures that present themselves during the normal cost of business.

Resolution to approve the Budget Transfers for the Year End 2020 Budget was made by Mayor Ceriello, seconded by Trustee Williams and approved by all.

Deputy D’Angelo reminded the Board that the FY 2021 Budget was finalized at the beginning of COVID-19 when the Village faced uncertainties as to the ramifications of a global pandemic to the budget.  The Board was conservative in forecasting permit fees at $160,000 of revenue, D’Angelo reported that the Village is exceeding expectations and trending at $145,000 of revenue with four months until year end. 

PUBLIC SAFETY REPORT

·         POLICE REPORT: The Police Report for December 7.was presented by Trustee Williams, stating 3 Auto Accidents, no Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, one Larceny (other than auto), no Criminal Mischief incidents and a total of 17 summonses (14 Movers and 3 Parkers). 

·         JUSTICE REPORT: The Monthly Justice Report for December 2020 was presented by Trustee Williams with total fines assessed in the amount of $2,775.

·         BUILDING REPORT: The Building Report was presented by Trustee Williams, stating that between June 1, 2020 and January 6, 2021, a total of 129 permits have been issued totaling $145,999.50 in Building Permit Fees.

NEW BUSINESS

·         Resident Yan Yu - 140 Munsey Place teleconferenced into the meeting to present his permit application to install a fence.  Mayor Ceriello explained that fences are generally prohibited in the Village.  The Board considers fence application on a case-by-case basis and it is based upon need.  The Board unanimously denied the application for the fence and suggested other less intrusive ways to protect the sanctity of the homeowner’s property.

·         Patricia O’Neil, Architect, teleconferenced into the meeting to present a Regrading Plan for 388 Park Avenue.  The application is to approve the existing grade of the newly installed retaining wall on the east side of the property line.  It was noted that this approval is for the grading only and not the aesthetic of the existing retaining wall which will be changed by the homeowner based on BAC approval.  The Board unanimously voted to approve the exiting grading of the retaining wall at 33 Park Avenue.

Mayor Ceriello made a motion to close the Board of Trustees meeting, seconded by Deputy Mayor D’Angelo and approved by all at 8:36 PM.

MAYOR’S REPORT

VILLAGE HISTORIAN

The Mayor read the following (2) two resolutions:
RESOLUTION FOR CREATION OF POSITION OF VILLAGE HISTORIAN
:

WHEREAS the Board of Trustees believes that an appreciation of the history of the Incorporated Village of Munsey Park will be valuable for present and future generations of residents and citizens of the Village and will help create a continuing sense of community and preserve for posterity the background persons and activities which helped to mold and create the community that is now the Incorporated Village of Munsey Park.

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRSUTEES OF THE INCORPORATED VILLAGE OF MUNSEY PARK, as follows:

Section 1. The position of Village Historian is hereby created.

Section 2. The Village Historian is authorized and directed to ascertain and document the existence of all facts, data, deeds, documents, photographs, paintings, artifacts, maps, etc., pertaining to the area now comprising the Incorporated Village of Munsey Park,  both from the time of its incorporation through the present, as well as similar data concerning the area where the Village is presently located which are of historical significance.

Section 3. The Village Historian is further directed and authorized to create a system for filing, cataloging and displaying historical artifacts of the Village and to maintain a system of ongoing accumulation of facts and documents which may or will prove to have historical significance in the future.

Section 4. The Village Historian is directed to coordinate efforts with the Mayor in order to determine an appropriate place to house the historic records of the Village and to secure budgeted funds for acquisition, storage and display thereof.

Section 5. The Mayor, with the Approval of the Board of Trustees, is authorized to choose a person to act as Village Historian, who shall be appointed by Resolution.  The term of office of the historian shall be for two (2) years and the Village Historian shall serve without compensation.

Section 6. This Resolution shall take effect immediately upon passage.

The forgoing Resolution was moved by Trustee LiCalzi, seconded by Trustee Im and approved by all.

RESOLUTION FOR APPOINTMENT OF VILLAGE HISTORIAN:

The following Resolution was proposed by Mayor Ceriello:

BE IT RESOLVED that ANDREW CRONSON, a resident of Trumbull Road in the Incorporated Village of Munsey Park, is hereby appointed as Village Historian.

The forgoing Resolution was moved by Deputy Mayor D’Angelo and seconded by Trustee Williams and approved by all.

VILLAGE ROADS

Residents have requested a stop sign on the corner Nassau Avenue and Thayer Road.  The Mayor is in favor of this request emphasizing the fact that the constant uphill traffic on Nassau Avenue presents a safety hazard to all pedestrians, and in particular the children who reside on those streets.  A motion to approve the stop sign (exact location to be determined) was moved by Trustee LiCalzi, seconded by Trustee Im and approved by all.

NATIONAL GRID

National Grid is replacing gas mains on several side streets in Munsey Park which include Remington, Abbey, Hunt, Whistler, Homer, Durand, Alston, Sargent and Revere.  Recently, Mayor Ceriello walked the designated streets with representatives from National Grid.  During that walk-through it was determined that most of the gas main road openings would occur along the concrete gutter; however, at times, the work will cross over and disrupt the entire concrete street panel.  The Mayor requested and National Grid agreed to open the concrete panel where the road is deteriorating and replace the road at no cost to the Village.

VILLAGE ARBORIST

Mayor Ceriello met with Richard Weir, a horticultural educator/consultant with over fifty years of experience.  Mr. Weir is currently working with several villages on Long Island to enhance their tree programs.  The Mayor stated that Mr. Weir could assist Munsey Park by creating a tree inventory and associated maintenance plan.  He can also assist, Trustee LiCalzi who is responsible for the Munsey Park Tree Pruning/Removal/Replacement Program, in approving/denying removals and selecting the proper replacement species and the location in which the tree will flourish.  The Board agreed that a Village Arborist is needed, and that Mr. Weir will be an asset to the Munsey Park Tree Program.

VILLAGE SECURITY

Trustee Williams stated that he and all Village employees met with the Homeland Security Division of the 6th precinct to learn various methods to improve security at Village Hall.  One method of security is a phone application called RAVE.  This security system allows employees to signal for an immediate emergency response from the 6th precinct.  The BOT will continue to discuss the Village’s security needs and the costs associated with the RAVE Program.

HOLIDAY HOURS

Mayor Ceriello announced the Village office holiday hours and the 2021 Holiday Schedule.

 

SKATING UNDER THE STARS

Trustee LiCalzi is responsible for Munsey Park’s 1st Annual Skating under the Stars.  He stated that residents are very excited, but the event is contingent upon cold weather and the subsequent freezing of the Copley Pond.

NEWSLETTER

The Mayor stated that the next issue of the Munsey Park’s Newsletter should be completed in the beginning of the New Year.  Trustee Im will be responsible for the upcoming newsletter which will be emailed to all the Village residents. 

FINANCIAL REPORT

Deputy Mayor D’Angelo stated that the distinctive expense items for the month of November 2020 were emergency repair of roads for $25,780 and maintenance to the Village trucks for approximately $3,200.    

PUBLIC SAFETY REPORT

·         JUSTICE REPORT: The Monthly Justice Report for November 2020 was presented by Trustee Williams with total fines assessed in the amount of $3,388.00.

·         BUILDING REPORT: The Building Report was presented by Trustee Williams, stating that between June 1, 2020 and December 6, 2020, a total of 129 permits have been issued totaling $132,253.50 in Building Permit Fees.

SNOW READINESS

Trustee Williams and Field Supervisor, Ted Boutzalis briefed the Mayor on the Village’s preparation for the upcoming snowstorm. 

NEW BUSINESS

·         A motion to approve permanent basketball hoops at 64 Vanderlyn Drive and 188 Kensett Road was made by Trustee LiCalzi, seconded by Trustee Williams and approved by all. 

·         A motion to approve the revised landscape plan for 5 Barnard Place (Frangella) was made by Deputy Mayor D’Angelo, seconded by Trustee Williams and approved by all.

·         The Mayor read the following resolution:

RESOLUTION FOR ISSUANCE OF BID BOOKS:

WHEREAS, the Board of Trustees has determined that that it is in the best interests of the Village to undertake road repair work within the Village, specifically to Park Avenue;

WHEREAS, in accordance with the applicable policies of the Village and the Laws of the State of New York, the Village wishes to solicit bids for the completion of such work, in accordance with the specifications as detailed by the Village Engineer.

THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby authorizes the issuance of a request for bids in accordance with the specifications of the Village Engineer and for the advertisement of such request for sealed bids on said project, to be received and opened in accordance with the specifications set forth by the Village Engineer.

The forgoing Resolution was moved by Trustee LiCalzi and seconded by Deputy Mayor D’Angelo and approved by all.

·        Munsey Park has been asked to renew our membership with the Manhasset Bay Protection Committee which is an inter-municipal organization focused on addressing water quality and coastal issues.  The Committee is funded through annual dues from the municipal members.  The Committee’s goals are to protect Manhasset Bay while balancing and maintaining recreational and commercial uses.   A resolution to renew Munsey Park’s membership in the Manhasset Bay Protection Committee for $1,800 for the 2021/2022 year was made by Trustee LiCalzi, seconded by Trustee Williams and approved by all.

There being no further business, a motion to go into Executive Session to discuss litigation and personnel issues was made by Trustee Williams, seconded by Trustee LiCalzi and approved by all.  At the end of the Executive Session, a motion will be made to re-open and close the public meeting.

 The minutes for the October 14, 2020 Board of Trustees meeting were approved by all.

NEW BUSINESS

Philip Rio, 129 Whistler Road, was in attendance to discuss the Village Code pertaining to sheds, specifically the required peak height, surface area, set back and screening.  Mayor Ceriello recognized Mr. Rio’s position and assured him that he will lead a future discussion with the Board.

MAYOR’S REPORT

VILLAGE ROADS

·         The Mayor stated that Jim Antonelli, Village Engineer, is preparing the bid books for the re-pavement of Park Avenue which will occur (weather permitting) in the Spring of 2021. National Grid will be installing new gas mains on Park Avenue, from Morse Lane to the end of Park Avenue/Port Blvd., including a small section of Trumbull Road and Bartlett Drive.  Installing the gas main will require the road to be cut out closest to the curb and then restored with a temporary patch. The Village will repave this section of the road, curb to curb, with National Grid incurring half of the costs.   The RFP will also include the re-pavement of Park Ave. from Morse Lane to the traffic light at Abbey Road. 

·         National Grid is planning a gas main replacement on Remington, Abbey, Hunt, Whistler, Homer, Durand, Alston, Sargent and Revere.  Mayor Ceriello walked the project area with National Grid and suggested that instead of tearing up the concrete streets that they obtain access through the concrete gutter.  The Mayor will continue to discuss various options that will allow us to partner with National Grid and achieve the greatest cost benefits to the road replacement projects throughout the Village. 

·         A section of Abbey Road was repaired by Northern Masonry after the road began to essentially collapse.  Typically, a road has ten inches of concrete with rebar, this section was found to have two inches of concrete with no rebar and no subsurface.  The Village plans on seeking reimbursement from the original mason company.

TREES

Mayor Ceriello walked Manhasset Woods Road with Field Supervisor, Ted Boutzalis and Frank Hefferin, to identify the trees that need to be pruned in the near future.

LIGHT THE NIGHT

Trustee LiCalzi stated that Light the night and the Third Annual Christmas Tree Lighting will be on Sunday, December 6, 2020.  He said that they will ask families to enter together at 5:30 PM, adhere to social distancing rules and wear face masks.  No food or refreshments will be served.   Trustee LiCalzi said that the tree lighting and visit from Santa will occur at 5:45 PM. 

FINANCIAL REPORT

Deputy Mayor D’Angelo stated that the distinctive expense items for the month are an emergency roadway repair by Copley for $12,782 and annual insurance renewal for $42,715.    

RESOLUTION – ELECTION

Mayor Ceriello offered the following resolution and moved for its adoption:

WHEREAS, the next General Election for Mayor and two Trustees each for a 2 year term for the Incorporated Village of Munsey Park, will be held on Tuesday, March 16, 2021 and

WHEREAS, Section 15-104 (3) (b) of the Election Law of the State of New York states that the Village Board of Trustees must designate by Resolution the polling place in each election district, and the hours during which polls are open;

NOW, THEREFORE, BE IT RESOLVED:

1.      That the one (1) polling place in the Village of Munsey Park will be in the Village Hall, 1777 Northern Boulevard, Manhasset, New York 11030; and

2.      Polls will be open for the General Village Election to be held on Tuesday, March 16, 2021, between the hours of 12 noon and 9:00 pm.

AND BE IT FURTHER RESOLVED, that the Village Clerk is authorized to publish a Notice stating that the polling place and the hours the polls will be open at least sixty (60) days prior to the General Village Election.

A motion to approve this resolution was made by Trustee LiCalzi, seconded by Trustee Williams, and approved by all.

RESOLUTION – JUSTICE COURT

A resolution to acknowledge the examination of the Justice Court Financial Statements was made by Trustee LiCalzi, seconded by Trustee Williams, and approved by all.

PUBLIC SAFETY REPORT

·         JUSTICE REPORT: The Monthly Justice Report for October 2020 was presented by Trustee Williams with total fines assessed in the amount of $1,860.00.

·         POLICE REPORT: The Police Report for October 2020 was presented by Trustee Williams, stating 1 Auto Accidents, no Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, one Larceny (other than auto), no Criminal Mischief incidents and a total of 9 summonses (8 Movers and 1 Parkers). 

·         BUILDING REPORT: The Building Report was presented by Trustee Williams, stating that between June 1, 2020 and November 13, 2020, a total of 123 permits have been issued totaling $111,276.50 in Building Permit Fees.

Trustee Williams stated that he and the Mayor met with the POP police and spoke to them about their efforts to increase enforcement regarding speeding and different traffic violations within the Village.  In addition, the 6th precinct is working to have an additional crossing guard approved for Hunt Lane and Manhasset Woods Road.  They also met with the Homeland Security Division of the 6th precinct and learned various ways we can augment the security at Village Hall.  Another meeting to educate Village Hall employees will be scheduled at a later date.

MAYOR’S REPORT

Village Roads

The Mayor stated that Northern Masonry has been making short-term road repairs for safety purposes around Copley Park and Abbey Road.  The road repairs will continue throughout the month and will include certain intersections on Manhasset Woods Road. National Grid will be installing new gas mains on Monday, Oct 19th on Park Avenue, from Morse Lane to the end of Park Avenue/Port Blvd., including a small section of Trumbull Road and Bartlett Drive.  Installing the gas main will require the road to be cut out closest to the curb and then restored with a temporary patch.   Later in the year, The Village will repave this section of the road, curb to curb, with National Grid incurring half of the costs.  The Mayor requested that Village Engineer, Jim Antonelli, provide an estimate of costs to include the additional pavement of Park Ave. from Morse Lane to the traffic light at Abbey Road.  Next week, Mayor Ceriello and Village Attorney, Robert Morici, will meet with Manhasset Lakeville Water District to discuss their upcoming water main project on Park Avenue, from Manhasset Woods Road to Ridge Crescent.  The Mayor will report his findings on the scope of work and the possibility of partnering with MLWD to repave that section of Park Avenue.

Crossing Guard

Mayor Ceriello stated that the Village has placed a request to the sixth precinct to add a crossing guard at the intersection of Manhasset Woods Road and Hunt Lane.  The Mayor’s request comes in response to the significant increase in the number of students walking to school, which could be related to the current pandemic.  Police officer, Joseph Altieri, from the Sixth Precinct’s Problem Oriented Policing (POP) Department is assisting the Village to expedite the approval.

Greater Council of Manhasset

Traditionally, The Village of Munsey Park has not been a member of the Greater Council of Manhasset Civic Associations, as it is a group originally formed to represent the interests of the residential areas in Manhasset that are not in an incorporated Village i.e., Terrace Manor, North Strathmore, South Strathmore, Bayview, Norgate and areas in Manhasset Hills.  The Greater Council of Manhasset meets once a month and is attended by representatives of each civic association and officials from the County, Town, and State.  Very often developers also attend to try to generate community approval on projects that will affect the entire Manhasset community.  Mayor Ceriello spoke with Richard Bentley, President of the Greater Council, who agreed that Munsey Park should have representation on the Board.  The Board decided on two potential representatives and the Mayor will reach out to see if they are interested in the position.

Halloween

The Mayor stated that Halloween, particularly on Ryder Road, is a community event not a Village sponsored event.  The Village will, however, continue to offer safety precautions as needed to our residents.

FINANCIAL REPORT

Deputy Mayor D’Angelo stated that the Village Court revenues are slightly down due to a decrease in police ticketing.  Building permit fees have slightly increased based on a year to year analysis. The storm costs were less than estimated but the Village plans on filing for FEMA recovery if/when those funds are released.  Two distinguishable expense items this month were for the repairs to the Village entrances and electrical work for new landscape lighting in Copley Park.

·         BUILDING REPORT: The Building Report was presented by Trustee Williams, stating that between June 1, 2020 and October 12, 2020, a total of 93 permits have been issued totaling $102,701 in Building Permit Fees.

·         Trustee Williams noted that he will reach out to the Sixth precinct this week to discuss the activities listed in the police report and the requested crossing guard.

NEW BUSINESS

Basketball Hoop – Mayor Ceriello requested to defer this application to approve a permanent basketball hoop at 188 Kensett Road to the November BOT meeting.

VILLAGE ELECTION

Mayor Cereillo announced the election will be Tuesday, September 15 at Village Hall from Noon to 9 PM.  Covid protocol will be strictly followed throughout the day.  Four candidates are running   Anthony Sabino (re-election), Gregory LiCalzi, Regina Im and John Dellaquila. 

APPOINTMENT OF DEPUTY MAYOR

Due to Covid we did not have an election in March and since then Deputy Mayor Jennifer Noone has moved with her family to South Carolina.  Mayor Ceriello announced that Trustee D’Angelo has accepted to take on the position as Deputy Mayor until March 2021.

SEPTEMBER 11, 2001

Mayor Ceriello announced the names of the Village residnets who lost their lives on September 11, 2001.  Thomas Burke, Paul R. Casio, James Connor, Joseph J. Dickey Jr., John F. Iskyan, Timothy C. Kelly and Frank Salvaterra.   The Mayor then asked for a moment of silence to reflect on these individuals and fragileness of life.

SUMMARY OF IMPACT OF SUPERSTORM ISAIS

Superstorm Isias presented mostly tree damage to the Village along with power outages that lasted up to two weeks.  There were anywhere from a dozen to eighteen trees down and many of them were in the park.  At first it was difficult to get a tree removal company to come in as emergency situations took priority. Nassau County has reached out to the Village to obtain an estimate on clean-up costs in the hopes that we can pass some of these costs on to FEMA.  Mayor Ceriello and the Board thanked the road crew for a phenomenal job responding to all damage incurred by this storm.

PARK AVENUE REPAVING PLANS

PSEG plans on rep[lacing gas mains on the eastern end of Park Avenue from Morse Place, around the bend including part of Trunbull Road and Bartlett Road.  PSEG will cut along the side of the road and has agreed to incur the cost to repave half of the road and the Village will be responsible for the other half.  Mayor Ceriello stated that PSEG mentioned starting in October/November but because of weather could be as late as the Spring 2021.   Jim Antonelli, Village Engineer, will scope out the costs for extending this paving project on Park Avenue to include the section from Morse to Abbey Road. 

NYSDOT GRANT OF $150,000

NYSDOT has awarded us a $150,000 grant for roadwork.  Mayor Ceriello stated that the funds have not been specifically earmarked towards any road project.   Manhasset Lakeville Water District will be working on water mains from Manhasset Woods Road to the top of hill on Park Avenue.  The Village is in preliminary discussions on how we can also be involved with this project to improve the quality of Park Avenue.   

UPDATE ON EXTENET

Trustee Sabino reported that Extenet will be submitting their construction schedule to remediate the problem caused when they installed an incorrect antenna to the cell tower located at the intersection of Manhasset Woods Road and Park Avenue. Extenet will also install a sprinkler system and a BOT approved landscape design to the base of the tower.

Mayor Ceriello announced that he would like the October meeting to be live with a teleconference option to any resident who would like to dial in.

Basketball Hoop – 34 Vanderlyn Drive

The application for a front yard basketball hoop at 34 Vanderlyn Drive was denied unanimously by the Board of Trustees based on the code strictly prohibiting basketball hoops to be installed in the front of homes.  The Board suggested the homeowner consider purchasing a portable hoop. 

Consideration of Landscaper Regulations Regarding Equipment and Working Hours

Resident, Abe Bronchtein, began the discussion on his position to limit the working hours of landscapers in the Village.  The Mayor reminded the BOT that after a year working on this issue the Town of North Hempstead announced new regulations that stated commercial landscapers will be prohibited from using gas-powered leaf blowers from June 15 to September 15.   Flower Hill has enacted a similar ban as well.  The Board had a lengthy discussion regarding the impact such regulations would have on the landscapers and homeowners.  The Board concluded that further study and cautious measures are necessary to make an informed decision.

Consideration of Stop Signs

A motion was made by Mayor Ceriello and seconded by Trustee Sabino and unanimously approved by all to approve stop signs at the following locations:

·         On north and south bound lanes of Manhasset Woods Road at Ryder Road

·         On north and south bound lanes of Manhasset Woods Road at Inness Place

·         On north and south bound lanes of Manhasset Woods Road at Revere Road

·         On east and west bound lanes of Park Avenue at Martin Place

MAYOR’S REPORT

·         The Safe Streets Initiative continues with Greg Del Rio, Director of Special Projects for Sam Schwartz Engineering.  Mr. Del Rio is going to reexamine his proposal for studying the problems with the safety of our streets in Munsey park.

·         The Mayor spoke with Richard Bentley, President of the Council of Greater Manhasset Civic Association.  The Mayor would like Munsey Park to have representation on this Council and suggested Jennifer Tantillo and Tara Kirkwood as potential candidates.  The representatives chosen would attend the Greater Council’s meetings and report back to the Board of Trustees.  The Board approved of his recommendation. The Council was meeting this evening to discuss the proposed 7-11 for Plandome Road.  Mayor Ceriello thought the proposal for a 7-11 convenience store on Plandome Road would not be an inappropriate addition to the Manhasset community.  Tonight’s Civic meeting is a perfect example of why it is important for Munsey Park to have proper representation.

·         The Town of North Hempstead’s Solid Waste Management Authority has an Inter-Municipal Agreement (IMA) with Munsey Park which expires in April 2020.  Mayor Ceriello will continue to review this agreement and will report his findings regarding the cost benefits if Munsey Park was not subjected to garbage flow control. 

·         Mayor Ceriello attended The Cow Neck Mayor’s February meeting.  At the meeting he had the opportunity to meet Mariann Dalimonte, TONH Councilwoman, and was able to discuss some of the issues that affect the Village. 

·         The Mayor reminded everyone that the Village Election is March 18th

FINANCIAL REPORT

Trustee D’Angelo reported that Nassau County has reassessed properties to reflect a Fair Market Value (FMV) system.  Currently the calculation for the Village Tax is:

FMV x .10 x Tax Rate = Village Tax

Some residents will see a change in the Village tax due to the change in the Fair Market Value assigned by Nassau County. 

BUILDING ADVISORY COMMITTEE REPORT

Trustee Williams reported that he is continuing to review the current policies and procedures pertaining to the Building Advisory Committee (BAC) meetings in accordance with the open meetings law.

ROADS

Deputy Mayor Noone reported that she has spoken to Jim Antonelli, Village Engineer, to obtain an estimate on “mill and pave” work for sections of Kensett Road and Bingham Circle.

POLICE REPORT: The Police Report for January 2020 was presented by Trustee Sabino, stating 3 Auto Accidents, one Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, no Larceny (other than auto), no Criminal Mischief incidents and a total of 47 summonses (44 Movers and 3 Parkers).  The Police Report for February 2020 was also presented, stating 4 Auto Accidents, no Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, no Larceny (other than auto), no Criminal Mischief incidents and a total of 14 summonses (9 Movers and 5 Parkers). 

BUILDING REPORT: The Building Report was presented by Trustee Sabino, stating that between June 1, 2019 and February 6, 2020, a total of 138 permits have been issued totaling $177,370 in Building Permit Fees.

NEW BUSINESS

GIRL SCOUT

Girl Scout Troop 548 member and MHS junior, Courtney Gibbons, presented an idea to the Board to obtain recyclable cans for the Village Parks.  Ms. Gibbons is in pursuit of obtaining the highest award a Girl Scout Senior can earn, the Gold Award.  Currently, neither Copley Pond and Waldmann Memorial Park park have recyclable containers for bottles and cans, just one container that collects all types of waste.  Her fundraising will cover all expenses for this environmental improvement project to the Village.

ELECTION

Deputy Mayor Noone announced that the Village of Munsey Park’s Election is on Wednesday, March 18th from Noon to 9 pm at Village Hall.  All four candidates were present and were given the opportunity to briefly introduced themselves to the Board.  The candidates running for the two open trustee seats are: John Dellaquila, Regina Im, Gregory LiCalzi and Trustee Anthony M. Sabino.

APPROVE THE ENGAGEMENT OF NEW ACCOUNTANT

Trustee Sabino made a motion to approve the engagement letter retaining the accounting firm Cullen and Danowski, and specifically Alan Yu partner thereof, seconded by Trustee Williams and unanimously approved by all.

188 RYDER ROAD

Deputy Mayor Noone made a motion to approve the enclosure of the existing side porch at 188 Ryder Road, seconded by Trustee Sabino and unanimously approved by all.

FINANCIAL REPORT

Trustee D’Angelo reported this month’s largest financial variables which includes upgrading Village Hall  computers ($4,500), Replace three batteries on our dump truck ($1,700), Fix the decaying pillars at the entrance of Park Avenue ($5,400) and paint new street signs ($1,200) which will be replaced this spring.   Trustee D’Angelo stated that the Village is preparing and will present the proposed 2021 budget at the March meeting, followed by the approval of the budget in April.

BUILDING ADVISORY COMMITTEE REPORT

Trustee Williams reported that the board is currently reviewing the Building Advisory Committee’s (BAC) process which includes applications, fees, architectural review guidelines and final approval.  Trustee Williams also announced that the BAC is excited to welcome a new committee member and Village resident, Mrs. Joanie Toth.  

ROADS

Deputy Mayor Noone reported that the Village is in communication with the MLWD regarding a possible shared work project on the repaying of parts of Park Avenue, specifically Ridge Crescent to Manhasset Woods Road.  MLWD intends to replace water main lines on Park Avenue in the fall of this year or in 2021.  Deputy Mayor Noone said that they are still in the preliminary phases of this project and will not know an exact time frame until further communication.  The Village would like to repave the rest of Park Avenue during this project, but a review of the current budget and the final debt payment of current road bonds from 2007 will determine this decision.  In the meantime, the Village plans on arranging another road project if the Park Avenue repave gets pushed off to 2021.  Kensett Road and Bingham Circle are in need of a road improvement and the Village will begin working with the Village engineer to arrange this project.

LOCAL LAWS

Mayor Ceriello presented to the Board Local Law #1- 2020 - Override of Tax Levy Limit, Local Law #2 – 2020 - Trespassing in Parks and Local Law #3 – 2020 – Traffic and Parking Regulations. (A transcript of the local laws and adoption is annexed to these minutes and available at Village Hall).

A Motion was made by Trustee Sabino to approve the Minutes of the December 9, 2019 Meeting of the Board of Trustees; said motion was Seconded by Trustee Williams and unanimously approved.

MAYOR’S REPORT

·       Mayor Ceriello reminded residents that boulders are not only dangerous but prohibited in the Right of Way (ROW).  The Right-of-Way is the Village-owned strip of land from the edge of the street back about 10 feet.  Its purpose is to allow the Village to build and maintain the street, curb and gutter and possible underground utilities.  This land is the responsibility of the homeowner but the Village has the right to determine what takes place there.   The Village code generally prohibits the placement of any permanent objects in the ROW.  The Mayor will be sending out a letter reminding homeowners who have boulders on the ROW that the Village will be strictly enforcing the Village Code and the boulders must be removed from their property.  If the resident does not comply in a timely fashion then the Village road crew will be instructed to remove and dispose of the boulders.  In addition, the Mayor will be reaching out to residents to remind them to have their house number visible for medical emergencies (ambulance, fire department) and to assist our Village building inspector.

·       Mayor Ceriello discussed a shared services agreement with the Manhasset Parks District that will enable our Village to use their crack filler machine.  Trustee Sabino made a motion for the Mayor to be given authority on behalf of the Board of Trustees to enter into negotiations and execute the draft of the municipal agreement with the Manhasset Park District for usage of their asphalt/crack sealing machine.  The motion was seconded by Trustee D’Angelo and approved by all.

·       Mayor Cerliello stated that he circulated to the Board two IT proposals for the upgrade of three Village Hall computers and a monthly service protection plan.   The system upgrades will be installed within the next month.

·       Mayor Ceriello announced that a Munsey Park resident undergoing a new home renovation project donated gently used windows and interlocking bricks that will be used to upgrade Village Hall.

FINANCIAL REPORT

·       Trustee D’Angelo announced that he will be looking at the new Nassau County assessment to see if the increase in property value will impact the Munsey Park Tax rate. 

·       Trustee D’Angelo reported that this month’s largest variable was the Road Work Improvement Project.

·       Trustee D’Angelo read aloud the budget transfers, followed by a motion to adjust the May 31, 2019 adopted budget to reflect the transfers in the adjusted budget, seconded by Mayor Ceriello and approved by all.  Such transfers are budget neutral in that they are just a reallocation from one account to another.

PUBLIC SAFETY REPORT

·       JUSTICE REPORT: The Monthly Justice Report for December 2019 was presented by Trustee Sabino with total fines assessed in the amount of $9,286.00.

·       POLICE REPORT: The Police Report for November 2019 was presented by Trustee Sabino, stating 3 Auto Accidents, 2 Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, no Larceny (other than auto), no Criminal Mischief incidents and a total of 56 summonses (56 Movers and 0 Parkers). 

·       BUILDING REPORT: The Building Report was presented by Trustee Sabino, stating that between June 1, 2019 and January 6, 2020, a total of 116 permits have been issued totaling $121,100.75 in Building Permit Fees.

NEW BUSINESS

214 Abbey Road – Shed

The residence located at 214 Abbey Road has a side shed which is consider an accessory structure and an application was submitted to legalize the shed.  The Mayor and the Board discussed the history of the shed on this property.  Following such discussion, the Board agreed that this property was fairly unique in the Village in that the shed was accessory to an in-ground pool, the shed was architecturally harmonious to the renovated residence and was limited in size as shown on the submitted plans.  The Mayor recommended to the Board to approve the shed as it stands with the condition that the current homeowner (Dr. Saini; T.J. Costello, architect) submits a detailed landscape plan with the type of species selected and height of plantings.  The Board and applicant agreed that the approval of the shed would be personal to the current owners (and applicants) and would not run with the land. Based on the foregoing, Trustee Sabino made a motion to approve the shed with the condition that a detailed landscape plan will be submitted, seconded by Deputy Mayor Noone and unanimously approved by all.

11 Blakelock Road – Contrary to Approved Plans

After discussion regarding previously approved plans for a renovation to 11 Blakelock Road,  Trustee Sabino made a motion to approve the windows as installed in the home, seconded by Deputy Noone and unanimously approved by all.

940 Park Avenue – Fence without Permit

At last month’s meeting, Mr. Kivotidis appeared to discuss the erection of a fence in the rear of his yard without a permits.  Since then Mr. Kivotidis has obtained all proper permits and has paid all associated permit fees and fines.  Trustee Sabino made a motion to approve the fence with the condition that the fence will be screened with evergreens on the house side, seconded by Deputy Mayor Noone and unanimously approved by all.  The resident has until the spring 2020 to complete the above mentioned screening. 

MINUTES: A Motion was made by Trustee Sabino to approve the Minutes of the November 13, 2019 Meeting of the Board of Trustees Meeting; said motion was Seconded by Deputy Mayor Noone and unanimously approved.

MAYOR’S REPORT

  • A Motion was made by Deputy Mayor Noone to approve the 2020 Munsey Park Village Holiday Schedule; said motion was Seconded by Trustee Sabino and unanimously approved.

  • A motion was made by Deputy Mayor Noone to approve December 12, 2019 as Arbor Day throughout the Village of Munsey Park; said motion was Seconded by Trustee Sabino and unanimously approved.

  • A motion was made by Deputy Mayor Noone to approve Inspectors of Election on Election Day on March 18, 2020: Christina and Kevin Toole at 289 Crabapple Road Manhasset, New York with the compensation at the rate of $150 per day; said motion was Seconded by Trustee Sabino and unanimously approved.

A Motion to Open the Public Meeting was made by Trustee Sabino, Seconded by Deputy Mayor Noone and called to Order by Mayor Larry Ceriello at 7:30 pm.

MINUTES: A Motion was made by Trustee Sabino to approve the Minutes of the October 9, 2019 Meeting of the Board of Trustees Meeting; said motion was Seconded by Deputy Mayor Noone and unanimously approved.

MAYOR’S REPORT: The Mayor reported that a beautification project occurred at the ‘triangle’ located at Bellows and Abbey. The “Grounds Guys” donated time and labor to landscape and clean the area, as well as plant daffodils and spread mulch, which was donated by the Munsey Park Women’s Club. The Mayor further reported that the Village has met with Greg Del Rio, a Traffic Consultant, who is currently working on a proposal to address speeding and volume of traffic in the Village, especially on Park and Manhasset Woods Road.

PUBLIC SAFETY REPORT:

JUSTICE REPORT: The Monthly Justice Report for October 2019 was presented by Trustee Sabino stating total fines assessed in the amount of $6,145.00.

BUILDING REPORT: The Building Report was presented by Trustee Sabino, stating that between June 1st, 2019 and November 7th, 2019, a total of 89 permits have been issued totaling $62,014.00 in Building Permit Fees.

BUILDING ADVISORY COMMITTEE REPORT: Trustee Williams reported to the Board that there was no new business to report with respect to the Building Advisory Committee.

VILLAGE ROAD UPDATE: Deputy Mayor Noone reported to the Board that the Bellows Lane project has been completed and that the Village was very satisfied with United Paving.

NEW BUSINESS:

ELECTION: Mayor Ceriello offered the resolution and moved for its adoption: WHEREAS, the next General Election for Two (2) Trustees, each for a 2-year term for the Incorporated Village of Munsey Park, will be held on Wednesday, March 18, 2020; and WHERAS, Section 15-104(3)(b) of the Election Law of the State of New York states that the Village Board of Trustees must designate by Resolution the polling place in each election district, and the hours during which the polls are open; NOW THEREFORE BE IT RESOLVED: (1) That one (1) polling place in the Village of Munsey Park will be in Village Hall, located at 1777 Northern Boulevard, Manhasset, new York 11030; and (2) Polls will be open for the General Village Election to be held on Wednesday March 18, 2020, between the hours of 12:00 noon and 9:00p.m. AND BE IT FURTHER RESOLVED, that the Village Clerk is authorized to publish a Notice stating the polling place and hours that the polls will be open at least sixty (60) days prior to the General Village Election. This Resolution was seconded by Trustee Williams and unanimously approved.

940 PARK AVENUE: Mr. Kivotidis appeared to discuss the erection of a fence in the rear of his yard without a permit. He was advised to contact the Deputy Clerk to facilitate him obtaining the proper permits. Mr. Kivoditis also inquired of the Board regarding roadway markings concerning no blocking driveway, as traffic backs up on Park Avenue No., preventing egress and entrance to his driveway. The Board agreed to consider his request.

STEVE FLYNN (Manhasset Water & Fire District): Commissioner Steve Flynn of the Manhasset Water & Fire District appeared to discuss future plans and upcoming projects of the Water District in Munsey Park. Commissioner Flynn stressed the District’s desire for intermunicipal cooperation between the District and the Village in upcoming projects. Commissioner Flynn also wanted to remind the Village residents that the election for Commissioner of the Manhasset Lakeville Water & Fire District will occur on December 10, 2019, at Company 1, located at 35 Bayview Avenue in Manhasset and hoped that all Munsey Park residents would come out to vote.

ALEX KATSOULIS: Eagle Scout candidate and Munsey Park resident Alex Katsoulis presented to the Board a presentation to construct a mulch basin, as part of his community service in attaining the rank of Eagle Scout. Mr. Katsoulis advised the Board of the benefits and logistics of the proposed Mulch Basin, as well as it’s planned funding. The Board Thanked Mr. Katsoulis and looked forward to working with him on this project.

CHRISTMAS TREE LIGHTING: Deputy Mayor Noone relayed the specifics of the Village’s tree lighting ceremony, which is being held by the Village, in conjunction with the Munsey Park Women’s Club, on December 8, 2019. The ceremony will start at 5:30pm at Waldmann Memorial Park with hot chocolates, treats and carolers and the festivities will move to Copley Park for the tree lighting at 6:00pm and the much-anticipated arrival of Santa at approximately 6:15pm. All residents are encouraged to attend. There will be some parking restrictions in effect on the date of the event. In the event of unfavorable weather, the rain date for the event is December 15, 2019. BEAUTIFICATION BRICK PROGRAM: The Village will once again offer the “Buy-ABrick” program to raise funds for the beautification of the Village’s parks. The Board anticipates that the inscribed bricks will cost approximately $100 and that approximately 250 will be available at Waldman Park.

Trustee D’Angelo stated that the Village had two non-recurring items on our financial statements for September for an upgrade to the lighting of Village Hall and a payment to our auditors, Satty Levine and Ciacco.

VILLAGE ROADS REPORT

Deputy Mayor Noone updated the Board on the Village’s 2019 Road Improvement Project which includes Bellows Lane, Stuart Place, Eakins Road and Burnham Place. The project is well underway with United Paving milling the streets this week followed by paving and road restoration. In addition, Nassau Avenue is having minor road repair due to on-going water issues.

NEW BUSINESS

Light the Night – Munsey Park Woman’s Club will again host Light the Night on December 8, 2019 with a rain date of December 15th or 16th. The Village of Munsey Park’s Second Annual Christmas Tree Lighting will occur on the same night as Light the Night. Additional information on these events to follow next month.

Extenet – Trustee Sabino stated that after a well-publicized hearing this spring the Munsey Park Board of Trustees granted Extenet’s application for a single wireless cell facility at the Village’s own triangle at the Northeast corner of Park Avenue and Manhasset Woods Road. To date, Extenet has taken no further steps to submit construction plans although they do have the legal right to do so at any time. Trustee Sabino wants to remind residents of this because of the recent actions of other neighboring villages who have denied or restricted Extenet’s ability to construct wireless cell facilities within their jurisdiction. The Village of Munsey Park has authorized only one such facility within our borders. Extenet satisfied all Federal requirements for doing so and especially provided scientific evidence that Extenet’s proposed facility falls well within the Federally mandated safety margins.

A Motion to close the meeting was made by Trustee Sabino and seconded Trustee D’Angelo and unanimously approved. The meeting was adjourned at 8:20 pm.

• POLICE REPORT: The Police Report for July 2019 was presented by Trustee Sabino, stating 2 Auto Accidents, no Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, no Criminal Mischief, 1 Larceny (other than auto) incidents and a total of 86 summonses (75 movers, 11 Parkers). The Police Report for August 2019 indicates 3 Auto Accidents, no Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, no Criminal Mischief, 1 Larceny (other than auto) incidents and a total of 43 summonses (31 movers, 12 Parkers).

• BUILDING REPORT: The Building Report was presented by Trustee Sabino, stating that between June 1, 2019 and September 11, 2019, a total of 63 permits have been issued totaling $50,564.00 in Building Permit Fees.

FINANCIAL REPORT

Trustee D’Angelo stated that the Village had two non-recurring items on our financial statements for July and August which were cleaning one hundred catch basins for $14,500 and repairing the storm drains for $6,000. These costs are in addition to the Village’s current Road Improvement Project.

VILLAGE ROADS REPORT

Deputy Mayor Noone updated the Board on the Village’s 2019 Road Improvement Project which includes Bellows Lane, Stuart Place and South Eakins Road. The project is well underway with the concrete curbing already removed and the current installation of the belgium block. The next phase will be milling and paving the roads which will also include Burnham Place. Deputy Mayor Noone stated that this project completes the worst roads in the Village (those indicated in red) as stated in the comprehensive road report. The Village will continue to follow the comprehensive road report as a guide for future road projects.

NEW BUSINESS

Mr. Carili, 74 Revere Road, spoke to the Board regarding his proposed landscape plans. Mayor Ceriello and the Board of Trustees agreed that the current proposed plans do not meet the Village’s Code. The Mayor requested a new landscape plan that indicates the differentiated and specific types of plants to be used and their location which should be in a staggered formation. Mayor Ceriello also reiterated that nothing can be planted in the Village ROW (Right of Way). Mr. Carili agreed to submit the new proposed plans to Deputy Clerk McLean which will be forwarded to the BOT for approval.

Mr. Tarantino, 98 Trumbull Road, came before the BOT to appeal the BAC’s decision to repaint the clapboard on the rear of the house to the color that was originally approved. Mr. Tarantino states that he did not fully understand that when he submitted the grey color to the BAC that he was locked into that specific color but rather thought it was just an indication that the paint color would be in the grey family. After much discussion over the BAC responsibilities and great respect for their process, it was unanimously decided, with one abstention from Deputy Noone, that the current paint color can remain.

A Motion to close the meeting and go into executive session to discuss personnel matters was made by Trustee Sabino and seconded Trustee D’Angelo and unanimously approved. The meeting was adjourned at 8:52 pm.

MINUTES

The minutes for the June 12, 2019 Board of Trustees meeting were amended by Trustee Noone and approved by all (amendment to the Road Improvement Section included a misspelling and inclusion of paving Burnham Place).

LOCAL LAW 3 - 2019

Gerard Morici, Moricic &Morici, read local law amending Article 1 of Chapter 132 of Village Code: “Peddling and Soliciting” in the Incorporated Village of Munsey Park, including ammendments to the requirements thereof and the hours permitted (Local Law 3 – 2019 is available at Village Hall or on our website under Codes). Trustee Sabino made a motion to adopt Local Law 3 - 2019, seconded by Trustee Williams and approved by all. An official copy of the transcript is annexed to these minutes.

NEW BUSINESS

Qu resident – 21 Alston Place

Paul Bloom, Harras Bloom & Archer - 445 Broad Hollow Road, Melville, appeared on behalf of the Qu’s of 21 Alston Place. The Qu’s received a violation issued from the Munsey Park’s Building Department referring to a violation of section 878-D of the Munsey Park Code (During the progress of the construction a set of plans and the statement of specifications bearing the certification stamp or signature of the Board's representative at all times shall be kept on the premises involved. All work shall be carried on in strict accordance with such plans and specifications). Mr. Bloom explained that his client, Mr. Qu, worked as his own general contractor. He explained that the work performed contrary to approved plans was not done in a purposeful way but rather by an unfortunate error. As of today, the portico and the platform does not conform to the approved plan with a discrepancy of 30 inches. The work involved to bring the portico to total conformity is quite extensive with an estimated cost of up to $30,000 for the homeowner. Mr. Bloom appealed to the BOT for relief stating that the portico is not inconsistent with other homes in the community. Norman Nemic, North Shore Architecture, came up with a solution to mitigate the visual impact by placing two additional columns closer to the front door. Mayor Ceriello explained that the Village has a BAC (Building Advisory Committee) for a reason and they work with homeowners extensively to come up with an approved plan. Mayor Ceriello believes that the Qu’s error was not deliberate but the fact remains that what was approved was not built. The Mayor acknowledged that the Qu’s have already made a large investment to construct this beautiful house and therefore, he and the BOT agreed to the installment of two additional same-sized columns.

PUBLIC SAFETY REPORT

JUSTICE REPORT: The Monthly Justice Report for June 2019 was presented by Trustee Sabino with total fines assessed in the amount of $4,124.00.

POLICE REPORT: The Police Report for July 2019 was presented by Trustee Sabino, stating 8 Auto Accidents, no Burglary-Residence, no Burglary-Business, no Robberies, no Larceny-Auto incident, 2 Larceny (other than auto) incidents, 1 Criminal Mischief incidents and a total of 76 summonses (73 movers, 3 Parkers).

BUILDING REPORT: The Building Report was presented by Trustee Sabino, stating that between June 1, 2019 and July 3, 2019, a total of 31 permits have been issued totaling $10,452.00 in Building Permit Fees.

VILLAGE ROADS REPORT

Deputy Mayor Noone updated the Board on the Village’s 2019 Road Improvement Project. The project went out to bid almost two weeks ago and the bid opening will be on Thursday, July 18th at noon at Village Hall. Village engineer, Jim Antonelli, will receive all the bids and provide the BOT with the results. The BOT will meet on July 22, 2019 to vote on a contractor. The winning contractor will then have to submit all paper work, issue appropriate bonds, sign contracts and look at their work schedule to provide the Village with an anticipated start date.

COPLEY POND

Trustee Williams updated the Board on the condition of Copley Pond. The water level of the pond was raised by the road crew and it looks noticeably better. Trustee Williams looked into several solutions to improve the aesthetics of the pond. One viable solution is to install a sub-surface aeration device. Adding a sub-surface aeration system is a great way to boost water quality and oxygen levels while maintaining the natural appearance of the pond. This style of aerator has four diffuser modules that sit at the bottom of the pond, connected by weighted tubing which is in turn connected to an air compressor. The compressor pumps much-needed air to the bottom of the pond, ensuring adequate oxygen levels during hot summer months. Benefits include more oxygen, clearer water, lower mosquito infestations, no maintenance, ten-year life expectancy with a cost of $4,200 total including installation. Another option is to add dye to the pond to enhance its visual appeal, it also plays a major part in limiting amount of sun exposure the pond receives. Trustee Williams also discussed the geese population at Copley and offered a solution using a Border Collie decoy that moves in the wind and deters geese and other unwanted varmint. Trustee Williams is going to look into having a possible “trial run” using one or two sub-surface aeration devices.

A motion to open the meeting of the planning Board was made by Trustee Sabino, seconded by Trustee Williams and approved by all. Mayor Ceriello called the meeting to order at 7:33 pm.

PLANNING BOARD

The Planning Board approved the O’Neill Preliminary Subdivision (A copy of the transcript will be annexed to the minutes in the Minutes Book at Village Hall).

Motion to close the meeting of the Planning Board was made by Anthony Sabino, seconded by Deputy Mayor Noone and approved by all.

FINANCIAL REPORT

Trustee D’Angelo reported That Village taxes are due by July 1, 2019. In addition, he reported that Village expenses for the month were approximately $111,000 with $40,000 going towards garbage removal, $12,000 for healthcare insurance, $15,000 for the Village Engineer and the remaining balance for Village maintenance.

MAYOR’S REPORT

The Mayor reported that in 2017 the BOT passed a resolution establishing a position of a Village Administrator and the position was never filled. Subsequent events have proven that position to be unnecessary. The mayor proposed the following resolution:

WHEREAS, on May 10th, 2017, the Board of Trustees Passed a Resolution establishing the position of Village Administrator;

WHEREAS, on May 10th, 2017 an appointment was made; however, said appointee refused appointment and the position was never filled;

WHEREAS, the Position of Village Administrator has never been filled and is not a necessity to the Village at the current time;

BE IT THEREFORE RESOLVED, the Position of Village Administrator of the Incorporated Village of Munsey Park, which was created by Resolution of the Board of Trustees on May 10th, 2017, be and hereby is abolished.

The forgoing resolution was moved by Trustee Noone and seconded by Trustee Williams, and upon a voice vote, adopted unanimous.

PUBLIC SAFETY REPORT

BUILDING REPORT: The Building Report was presented by Trustee Sabino, stating that between June 1, 2019 and June 5, 2019, a total of 3 permits have been issued totaling $1,600.00 in Building Permit Fees.

VILLAGE ROADS REPORT

Deputy Mayor Noone updated the Board on the Village’s 2019 Road Improvement Project. The project includes new curbing, asphalt and belgian blocks for South Eakins Road, Bellows Lane and Stuart Road and the repaiving of Burnham. Deputy Mayor Noone added that the project is a few weeks behind schedule because our Village Engineer had some grading issues. We should be receiving the bid books this week. The end of July/beginning of August is the anticipated construction date.

NEW BUSINESS

305 Kensett Road – Application for a Rear Yard 6 foot Fence on the Village Boundary

Trustee Sabino made a motion to approve the application for a 6 foot fence in rear yard, seconded by Deputy Mayor Noone and approved by all, with Trustee D’Angelo abstaining.

Movie Night – June 24, 2019

Teresa McCabe, co-chair of children’s events for Munsey Park Woman’s Club, presented to the board the details of the Village’s Second Annual Movie Night which will take place at Waldmann Park on June 24th at 8:30 pm. The movie this year will be the Mighty Ducks. The Village has agreed to pay for the screening costs associated with this event. The rain date will be on June 25th. The MP road crew will put up no parking signs and will notify the 6th precinct of this event.

Meadow Carting/385 Ryder Road Dispute

The residents of 385 Ryder Road allege Meadow Carting had caused damage to their newly paved driveway. Meadow Carting tried several times to power wash the driveway but it could not get it back to its original condition. The homeowner had to have the driveway fixed by a mason and incur the associated costs. The homeowner came before the Board to ask for assistance to recover their costs from Meadow Carting. The Mayor explained that the Board cannot establish guilt from one party to the other, however, he agreed to communicate with Meadow to try to establish a resolution.

74 Revere Road – Regrading Application

The BOT approved the regrading at 74 Revere Road. The homeowner’s landscape architect will be meeting with our Village Building Inspector on Friday, June 14th to discuss the architectural drawings. These drawing are required based on the land survey and will include materials for the patio and landscaping.

FINANCIAL REPORT

Trustee D’Angelo reported that at the last meeting the BOT passed the Village’s fiscal budget for the 2019/2020 year. Closing out fiscal year 2019 revenue from the Village’s building permits was $138,047 and revenue from traffic fines/penalties was $70,000. Currently at month’s end traffic fines/penalties total $9,522. Trustee D’Angelo also reminded the Board that the tax bills will be sent out the end of May and are due July 1, 2019.

BUILDING REPORT: The Building Report was presented by Trustee Sabino, stating that between June 1, 2018 and May 1, 2019, a total of 149 permits have been issued totaling $138,047.48 in Building Permit Fees.

VILLAGE ROADS REPORT

Deputy Mayor Noone updated the Board that our Village Engineer, Jim Antonelli, is preparing the bids for the South Eakins, Bellows and Stuart Road improvement project. The project includes new curbing, asphalt and Belgium blocks with a projected July construction date. Deputy Mayor Noone also added that the Village is currently improving the compromised structural components of our catch basins/sewers. The sewers/catch basins are being reinforced, cleaned out and the streets will be swept during the month of June.

PROCLAMATION

Mayor Ceriello read a Proclamation in honor of P.O. Glen Demeo, who served Munsey Park for 23 years, on the occasion of his retirement. The Mayor expressed his deepest gratitude to Officer Demeo on the service he provided to Munsey Park and wished him well in his retirement.

NEW BUSINESS

575 Park Avenue – Application for a Permanent Basketball Hoop

Trustee Williams made a motion to approve the application for a permanent basketball hoop in the rear of 575 Park Avenue, seconded by Trustee Sabino and approved by all.

305 Kensett Road – Application for a Rear Yard Fence on the Village Boundary

Trustee Noone made a motion to approve the application for a 4-foot wood fence in the rear yard line of 305 Kensett, seconded by Trustee Williams and approved by Mayor Ceriello and Trustee Sabino. Trustee D’Angelo voted no.

24 Vanderlyn Drive – Application for a Rear Yard Stone Planting Wall

Trustee Sabino made a motion to approve the application for a re-grading in the rear yard to accommodate a stacked stone planting wall, seconded by Trustee Williams and approved by all.

82 Borglum Road – Appeal to Keep Existing Garage Door

TJ Costello, Architect - Hierarchy, came before the Board to appeal to keep the existing garage door at 82 Borglum Road. The original catalog cut that was presented to the Building Advisory Committee (BAC) by Heiracrchy was incorrect as the sample showed the garage doors having glass. The intended garage door was a solid panel (no glass) similar to the pre-existing garage door. Mayor Ceriello acknowledged Hierarchy’s error and agreed that fairness dictates to approve the garage door that was installed. Trustee Williams made a motion to approve the existing garage doors, seconded by Trustee Sabino and approved by all.

369 Ryder Road – Filing to Maintain Existing Retaining Wall

TJ Costello, Architect - Hierarchy, came before the Board to discuss the amendment to the approved plans for a retaining wall in the rear yard at 369 Ryder Road. The work done to construct the retaining wall was completed contrary to what was originally approved by the BAC. Mr. Costello did submit an amendment to the original plans and applied for approval but it was indeed after the fact. Mayor Ceriello agreed to approve the completed work but will consult with the Village’s Building Inspector to confirm the status of any open violations and/or fines associated with this project. Trustee Sabino made the motion to approve the existing retaining wall, seconded by Trustee Williams and approved by all.

Audited Financial Statements – Village Justice Court

Trustee Sabino made a motion to approve the Audited Financial Statements for the Village Justice Court for year-end May 31, 2018, seconded by Trustee Williams and approved by all.

Memorial Day

Deputy Mayor Noone announced that the Village will be holding its Second Annual Memorial Day Service at Waldmann Pond to honor all those who sacrificed their lives for our freedom. Greg LiCalzi, Munsey Park resident, is once again organizing this wonderful event which takes place on May 27th at 9 am.

A Motion to close the meeting and go into executive session to discuss litigation and personnel matters was made by Deputy Mayor Noone, Seconded by Trustee Sabino and unanimously approved. The meeting was adjourned at 8:13 pm.
